1. Acceptance of Terms
By accessing and using ozehr, the electronic health record platform operated by ozehr LLC, and related services, including the patient portal, mobile application, and communication services (collectively, the "Services"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Services.
ozehr is operated by ozehr LLC, a Nevada limited liability company. Public business mailing address: 732 S 6th St, Ste N, Las Vegas, NV 89101.
2. Description of Services
ozehr LLC provides ozehr as a cloud-based electronic health record platform for healthcare providers and their patients. Services include appointment scheduling, clinical documentation, patient messaging, lab result delivery, prescription management, billing, and SMS/email notifications.
3. SMS and Email Communications
If you choose the affirmative SMS consent option within the standalone preference control, you expressly consent to receive recurring transactional SMS text messages from ozehr, operated by ozehr LLC, including appointment reminders and confirmations, lab result availability notifications, care-related messages from your provider, and account or portal notifications. This registered toll-free messaging program does not send promotional or marketing SMS.
SMS consent is collected through a digital-form checkbox presented separately from account creation. The checkbox is unchecked by default and the patient must actively select it. Consent is optional and is not a condition of receiving care or creating an account.
Message frequency varies based on appointment schedule and care activity, up to 5 messages per week.
Message and data rates may apply. Carrier rates apply. ozehr LLC does not charge for SMS notifications.
Reply STOP to opt out at any time. Reply HELP for assistance, update preferences in the portal, or contact contact@ozehr.com or 775-239-9991. After STOP, no further SMS messages will be sent unless you opt in again.
Carriers are not liable for delayed or undelivered messages.
4. User Accounts
You are responsible for maintaining the confidentiality of account credentials and for notifying your provider if you suspect unauthorized access. ozehr LLC reserves the right to suspend accounts that violate these terms.
5. Privacy and Data Protection
Your use of the Services is also governed by our Privacy Policy. ozehr LLC follows HIPAA requirements and applicable state privacy laws for the handling of PHI.
6. Prohibited Uses
You agree not to use the Services for unlawful purposes, attempt unauthorized access, interfere with operation, transmit malicious code, or impersonate another person or entity.
7. Intellectual Property
The Services, including software, designs, text, graphics, and related content, are owned by ozehr LLC and protected by intellectual property laws. Use is granted as a limited, non-exclusive, non-transferable license.
8. Disclaimer of Warranties
The Services are provided "as is" without warranties of any kind. ozehr LLC does not provide medical advice; the platform supports providers and patients and does not replace clinical judgment.
9. Limitation of Liability
To the fullest extent permitted by law, ozehr LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Services.
10. Changes to Terms
ozehr LLC may modify these Terms at any time. Material changes may be communicated by email or through the Services. Continued use after changes constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles.
