1. Acceptance of Terms
By accessing and using the Oz Health electronic health record (EHR) platform and related services, including the patient portal, mobile application, and communication services (collectively, the “Services”), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Services.
2. Description of Services
Oz Health provides a cloud-based electronic health record platform for healthcare providers and their patients. Services include but are not limited to: appointment scheduling, clinical documentation, patient messaging, lab result delivery, prescription management, billing, and SMS/email notifications.
3. SMS and Email Communications
By providing your phone number and/or email address and opting in to communications, you consent to receive transactional messages from Oz Health, including:
- Appointment reminders and confirmations
- Lab result availability notifications
- Care-related messages from your provider
- Account and portal notifications
Message frequency: Message frequency varies based on your appointment schedule and care activity. Typically 1–5 messages per week.
Message and data rates may apply. Your carrier's standard messaging rates apply. Oz Health does not charge for SMS notifications.
Opt-out: You may opt out of SMS messages at any time by replying STOP to any message. You may also manage your communication preferences through the patient portal or by contacting your provider's office. After opting out, you will receive a one-time confirmation message. You may opt back in by replying START or updating your preferences in the portal.

4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify your healthcare provider immediately if you suspect unauthorized access to your account. Oz Health reserves the right to suspend accounts that violate these terms.
5. Privacy and Data Protection
Your use of the Services is also governed by our Privacy Policy. Oz Health complies with the Health Insurance Portability and Accountability Act (HIPAA) and applicable state privacy laws regarding the handling of protected health information (PHI).
6. Prohibited Uses
You agree not to: (a) use the Services for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the Services; (c) interfere with or disrupt the Services; (d) transmit malicious code; or (e) impersonate another person or entity.
7. Intellectual Property
The Services, including all software, designs, text, graphics, and other content, are owned by Oz Health and are protected by copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Services for your internal business purposes.
8. Disclaimer of Warranties
The Services are provided “as is” without warranties of any kind. Oz Health does not provide medical advice. The platform is a tool for healthcare providers and patients and does not replace the professional judgment of your healthcare provider.
9. Limitation of Liability
To the fullest extent permitted by law, Oz Health shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
10. Changes to Terms
Oz Health reserves the right to modify these Terms at any time. We will notify users of material changes via email or through the Services. Continued use after changes constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
